Chapter 13 Bankruptcy

Many people who are not familiar with bankruptcy do not know that Chapter 13 exists. A Chapter 13 is different than a Chapter 7, where you are essentially released of all your debts but will not get to keep any of your assets. In a Chapter 13, you keep your home and vehicle and will have 5 years (with interest stopped) to pay back what is owed on your mortgage and car loan.

Chapter 7 is often what many people think of when they think of bankruptcy. Chapter 7 gives you a clean slate. It does not protect your home from foreclosure, so if that is a concern for you, then you will want to file a Chapter 13. Chapter 7 bankruptcies are also less expensive to file. It will last longer on your credit report than a Chapter 13, but nothing is worse for your credit than continuing to miss payments for years!
