In San Francisco, Oakland, and other cities with local Rent Ordinances, a tenant has been constructively evicted when a tenant is forced to move out of a rent-controlled home due to a landlord's actions or inactions.

In California a landlord has a duty to provide their tenants with safe, sanitary housing. A wrongful eviction occurs when a landlord evicts a tenant in violation of a local rent ordinance or California State Law. In San Francisco, Oakland, Berkley and other cities with a local ordinance a landlord can only evict a tenant with a "just cause" for eviction. Tenants who have been wrongfully evicted may be entitled to substantial monetary damages.
