Our firm is dedicated to providing the highest level of legal service to the injured and disabled in Western New York. Together they forged a friendship and eventual partnership that lasted thirty years until John's sudden and unexpected death in 2012. After graduating from Albany Law School in 1986, Stephen practiced law in Albany, New York developing his litigation and trial skills primarily in personal injury and accident law.

Workers’ Compensation

Workers' Compensation pays benefits to workers injured on the job, but it doesn't pay for pain and suffering and includes only a percentage of the wages you earned at the time you were hurt. Workers' Compensation does not pay for pain and suffering. Now more than ever, insurance companies will aggressively fight to reduce your weekly benefit or suspend it all together.
Pain and Suffering Claims

Pain and suffering are very real when you are injured, especially if the injury is serious and disabling. Did you know that in workers' compensation cases you can't collect for pain and suffering for your injuries? It doesn't seem fair. But sometimes you can collect for pain and suffering for an on-the-job injury if the injury was caused by the carelessness of someone else other than your employer or co-worker.
Personal Injury

In personal injury, whether you're injured on the job or not, you must prove that someone else was at fault or legally responsible for your injuries. In a personal injury case you can collect for things that you can't collect for in workers' compensation-most importantly, pain and suffering.

But in personal injury, whether it be a construction accident or car accident, you can't bring claim against your employer or a co-worker, even if they're at fault.That's not to say you can't have both a workers' compensation and a personal injury claim arising out of the same work-related accident-it happens all the time.
