The Consultation

At the initial consultation, we will first determine if you are eligible to file for a divorce in the State of New York. Like all states, New York has residency requirement. Either party has been a resident of the state for a continuous period of at least two years immediately preceding the commencement of the action.
Commencement
Report
In New York, a divorce case is commenced with the filing of either a Summons With Notice or Summons With Verified Complaint. The Summons With Notice is typically a one- to two-page document served on your spouse that notifies them you have commenced a divorce action. A Summons With Verified Complaint is a document wherein the actual allegations as to the reasons for the divorce are delineated.

Recently, New York moved to a formula based approach to both temporary (while the divorce is pending) and final (post-divorce) maintenance formula. In divorce matters, there is no right to a trial by jury - a Judge will make all decisions in your case.
