When someone passes and their Estate Plan does not include a Trust, or if that Trust is not properly funded, or if there are disputes among the beneficiaries or heirs about the Will or Trust, you may need to file or respond to a petition in Probate Court.

When a person passes with only a Will, and their assets are titled only in their name, the Probate Court overseas the administration of the estate and the transfer of assets to beneficiaries named in the Will.This process is typically administered by the Personal Representative/Executor named in the Will and aided by a probate attorney.
