Questions
What estate planning documents are essential for New Jersey residents?
Essential documents include wills, revocable living trusts, durable powers of attorney, and healthcare directives. These ensure proper asset distribution, decision-making authority during incapacity, and healthcare preferences documentation.
How can Medicaid planning protect my assets?
Medicaid planning uses legal strategies like irrevocable trusts and asset transfers to protect resources while qualifying for government assistance. Proper planning preserves family wealth while ensuring access to necessary long-term care services.
What happens if I don't create an estate plan?
Without planning, state intestacy laws determine asset distribution. This often results in unintended beneficiaries, family conflicts, and prolonged probate processes that deplete estate value through unnecessary legal expenses.
How does dementia planning differ from standard elder law services?
Dementia planning requires specialized legal tools addressing progressive cognitive decline. It combines traditional elder law protections with unique provisions for evolving decision-making capacity and structured caregiving support frameworks.
Can I update existing estate documents?
Yes, we recommend reviewing and updating documents every 3-5 years or after major life events. Our team helps revise wills, trusts, and directives to reflect current wishes and changing legal requirements.

I am so grateful to Van Dyke Law! I do not live locally and am only able to help my parents through phone contact. Leslie is a Godsend! She is always very responsive to my calls and went above and beyond to assist my parents with a real estate transaction. She understands that not all elders know how to utilize today's technology, which creates a great deal of stress for them. My parents raved about the entire Van Dyke team. As a person who has hearing loss, my step-father told me that Fiona was easy to talk to and understand and he felt she really listened to him! I spoke with him today and he

Fiona facilitated a webinar through the South Brunswick Senior Center . She provided a log of useful information about items to consider for the "2nd Half of your Life". I haven't utilized the services at this time, however will consider if and when needed down the road.
