After your arrest, the clerk's office will schedule your first court date called the "arraignment" in front of the judge. For individuals that do not have an attorney, the court will read the charges and ask the person to enter a plea - either guilty, no contest or not guilty. A conviction means you can never seal or expunge that mug shot, arrest record, or court record of the conviction.

Florida law distinguishes between civil traffic infractions and criminal traffic violations. Civil traffic infractions are only punishable by a fine. Chapter 893, F.S., contains different provisions criminalizing the possession, sale, purchase, manufacture, and delivery of controlled substances. F.S., provides penalties for drug trafficking offenses which include the minimum mandatory sentences and fines. Those penalties for drug trafficking crimes increase in severity as the quantity of the controlled substance involved increases.

Update: Effective on 7/1/19, the State Hemp Program (2019 CS/CS/SB 1020) took effect. Now that hemp is legal under Florida law, it raises many new defenses for fighting possession of cannabis charges.
Since hemp became legal, prosecutors are dropping charges because of bigger problems with the sniff or smell search, presumptive roadside tests for probable cause, or evidentiary problems with proving the THC level of the cannabis or marijuana (to distinguish it from legal hemp).Although possession of cannabis is legal for recreational purposes in many states, Florida law still imposes harsh penalties for the possession of marijuana.
