When your family includes minor children (under age 18, or up to age 19 if still enrolled full time in high school or an equivalent), the court will want to assure that both parents have sufficient financial resources to care for your child(ren). The court can order child support. Child support is an obligation to pay support for a marital or non-marital child.

Custody and placement can be the most concerning issues in a family case with minor children. Parents are often very concerned about how the court orders will affect the children. In Wisconsin, the law presumes that both parents should share joint legal custody. There are, of course, circumstances in which there should be an exception and only one parent should be awarded sole legal custody.

Parents in a family case with minor children are usually very concerned about how much time he/she will get to spend with the child(ren). In any action affecting that family, including but not limited to divorce, legal separation, or paternity that involves a minor child, the court must issue an order that allocates periods of physical placement of the minor child.

What will it take to get your divorce? Because Wisconsin is a no-fault divorce state, the court is not interested in why a party is seeking a divorce. In order for the court to grant a divorce, the court must be convinced that the marriage is irretrievably broken. This is usually accomplished by the testimony of both spouses.
