Uncontested Divorce
Report
Many people considering divorce believe that they have an uncontested divorce and therefore do not need the assistance of an attorney. However, divorce involves making many difficult, and often unanticipated decisions that couples can't easily agree on. Those hard choices can turn a simple, uncontested divorce into an adversarial, contested divorce.
Parental Relocation
Report
Parental relocation of a child or children after a divorce or paternity judgment can be a very contentious and complex issue. At Douglas E. Spiegel P.A., an experienced attorney can help guide you through the process and present your arguments in the most effective manner before the court.

When a custodial parent wishes to relocate with a child more than 50 miles away, that parent must follow specific procedural rules, and demonstrate to the court that the move is in the child's best interest.Florida statute 61.13001 guides the party through the factors the court will consider in determining whether the move is in the child's best interest.
Alimony
Report
In a divorce proceeding, the court may grant alimony to either party. There are five types of alimony in divorce cases: permanent, rehabilitative, bridge-the-gap, temporary and lump sum alimony. The financial resources of each party, the nonmarital and the marital assets and liabilities distributed to each.
Child Custody
Report
Interestingly, the term "custody" is no longer found in the Florida Statutes. In general, courts will make time sharing decisions based on the Best Interest of the Childs standards.

Factors that are considered before reaching these decisions include which parent is most likely to allow open and frequent access to the children by the non-custodial parent and other important family members; which parent is the better nurturer; the children's relationships with the respective parents; each parent's work hours; and the relative stability that each household could provide.
