Attorney Bio
Report
Michelle Neal developed a passion for immigration law when her family was forced to flee the Liberian civil war in the 1980s. She has firsthand knowledge of varying obstacles immigrants must overcome in order to experience the opportunity to live in peace and to work to provide financial stability, shelter and healthcare for one's family.
Convention Against Torture
Report
If you believe you will be tortured if forced to return to your home country, you may apply for protection under the Convention Against Torture (CAT). There is no formal application to submit a CAT claim but there is a box on Form I-589, Application for Asylum and Withholding of Removal, that you can check if you wish you apply for CAT protection.
Removal
Report
Immigration court proceedings are less formal than normal court proceedings. No jury will be present, less scripted legal language needs to be used, and everyone generally understands that the immigrant may not be familiar with American legal procedures. The immigration judge (IJ) is expected to act in an impartial manner.
Immigration Through Family
Report
Now, same-sex couple enjoy the same immigration benefits as opposite-sex couple. There are special rules for prospective spouses of U.S. citizens who can apply for a fianc(e) visa and prospective adopted children; the processing time varies depending on your category and circumstances. The quickest and most common way to get a Green Card is through a marriage to a U.S. citizen.
Naturalization
Report
For Green Card holders in the U.S., the path to becoming a U.S. Citizen is through a process called Naturalization. There is no set definition for "Good Moral Character." The government will generally look at the five years before your application to see if you have committed any crimes and ask questions if they suspect any questionable activity.
