Consumer Defense Against Collection Lawsuits

Consumers who are sued by creditors and the debt collection law firms that they hire to file the lawsuits, have the right to defend themselves in court. In some select states, third-party debt collectors are allowed to file suit on behalf of their clients who they are collecting for.

State and federal laws provide the ability for consumers to defend themselves against lawsuits that are improperly or wrongfully filed against them, and to assert counterclaims against the companies that sue them.Some consumers who are sued do not even owe the alleged debt that is being asserted as being owed by them, as some consumers are the victims of identity theft.

According to the CLA, a consumer lease is defined as a contract for the use of personal property by an individual that extends for a period of over four months. The contractual obligation of a consumer lease cannot be greater than $50,000 (adjusted annually for inflation). The main goal of the CLA is to make sure that consumers are given sufficient information when shopping for a lease.
Unauthorized Withdrawals and Improper Charges

Both state and federal laws prohibit unauthorized withdrawals from being taken from your bank account or charges made to your credit card without your express consent having first been obtained for that to occur. Some laws require this consent to have first been obtained expressly in writing.

If it is not obtained prior to the withdrawals/charges, you might be entitled not only to the return of the illegally withdrawn or charged amounts but also to statutory damages and for your attorney's fees and costs to be paid.

Payday loan companies have regulations imposed on them in multiple states that these lending companies are required to follow. In Massachusetts, for example, any company giving out a consumer loan for $6,000 or less at an annual rate of more than 12% has to be licensed with the Massachusetts Division of Banks.
