Mr. Eisenberg is one of only a handful of criminal defense attorneys (seven, to be exact) in all of Sarasota County who has been recognized by the Florida Bar as a Board Certified Criminal Trial Specialist.

There's a reason why there are so few board certified criminal defense attorneys. That's because the Florida Bar's requirements for board certification are so difficult to achieve! Only lawyers who have been recognized by the Florida Bar as "Board Certified" are ethically entitled to call themselves an "Expert" or "Specialist" in their area of the law.

Prior to becoming an attorney, Mr. Eisenberg enlisted in the U.S. Marine Corps where he served for 11 years before being honorably discharged as a Sergeant. He proudly served his last tour of duty stationed at Headquarters, Marine Corps, in Arlington, Virginia. Mr. Eisenberg went on to law school at The Catholic University of America Columbus School of Law, in Washington, D.C.

Should a defendant's statements be thrown out because he/she was not read their Miranda rights?. A defendant's Miranda rights only come into play when the defendant is considered "in custody" AND "is subject to interrogation." Thus, if a law enforcement officer arrests you, but doesn't ask you any questions that could elicit an incriminating statement, then they don't have to read you your Miranda Rights.
