Bankruptcy
Report
If you are facing a large amount of debt, you have options to achieve financial freedom. Bankruptcy is a federally protected tool allowing individuals and businesses to eliminate or repay debts over a period of time. There are several different types of bankruptcy, each with different eligibility requirements and each with their own pros and cons.
Chapter 7
Report
Chapter 7 is a common form of bankruptcy that allows individuals and businesses to wipe out many debts for a fresh financial start. It is referred to as both "straight" and "liquidation" bankruptcy since the filer's property is liquidated by the bankruptcy trustee to pay off creditor debt. Chapter 7 is pertinent for those who have accumulated insurmountable debt, especially unsecured debt, such as credit card debt.
Chapter 11
Report
Filing for Chapter 11 bankruptcy is generally an action taken by a business that has too much financial obligation or debt. Anyone, including individuals and couples, can actually file for bankruptcy under this Chapter, but the most common scenario involves corporations, limited liability companies, and partnerships.
Chapter 13
Report
If you do not qualify for Chapter 7 bankruptcy, you still have the option of filing for bankruptcy under Chapter 13. This type of bankruptcy is available to both consumers and sole proprietors of small businesses. Like Chapter 11, it involves a reorganization plan that will pay off a portion of unsecured debt over time.
