At the time of your arrest, the police officer likely presented you with a Notice of Suspension/Temporary Driving Permit (DIC - 25). Hopefully you have thoroughly read this document and are aware that your driver's license will automatically be suspended 40 days from the date of arrest (or the date you were served with the notice, whichever is later) unless you or your attorney requests a hearing in the manner prescribed by law.

The Horizontal Gaze Nystagmus test is the first test that is supposed to be administered by the police officer. This is the "Pen Test" where a pen (or other stimulus) is passed in front of your face back and forth in order for the officer to determine if HGN is present in your eyes. Law enforcement claims that the HGN test is 88% accurate at determining if someone is 0.08 or above.

Texas law requires that a request for a hearing to keep your license must be made within 15 days from the date of your DWI arrest. If you fail to hire an attorney, and a hearing is not requested, you waive the opportunity to fight the license suspension. In short, the sooner you act the better chance I will have in providing the best DWI defense you need.
