Chapter 7 Bankruptcy
Report
In a Chapter 7 bankruptcy, all your debts are wiped out by court order, except some taxes, some student loans, and alimony or child support. There are some other exceptions to discharge which we can tell you about. You also have to keep paying on your home mortgage or car loan if you want to keep these items.
Chapter 13 Bankruptcy
Report
A Chapter 13 bankruptcy is a repayment plan lasting three to five years, depending on your income level. You pay off your debts in full or in part, based on your ability to pay. At the end of the case, all the balances on your debts are discharged, even if they have been only been partially paid off, except your mortgage, student loans, child support, and some other exceptions we can tell you about.
Foreclosure Defense
Report
If your home mortgage is being foreclosed because you're behind on payments, you can stop the foreclosure and get time to catch up by filing a Chapter 13 plan. This is one of the main purposes Congress had in mind when it enacted Chapter 13 - giving homeowners a chance to keep their homes while requiring your lender to wait while you catch up on payments you've missed.
