California has two primary DUI laws for adult drivers: Vehicle Code 23152(a) VC, which makes it illegal to drive under the influence of alcohol, and Vehicle Code 23152(b) VC, which makes it illegal to drive with a BAC of.08% or greater. PC allows a defendant to withdraw a plea of guilty or no contest, to reenter a plea of not guilty, and to have the case dismissed. When granted, the expungement releases an individual from many of the negative consequences of a criminal conviction. Served time in state prison, but would have served it in the county jail had the crime been committed after implementation of "Realignment" under Proposition 47.1.
